{"id":1947,"date":"2022-05-01T01:45:04","date_gmt":"2022-05-01T01:45:04","guid":{"rendered":"https:\/\/ahda.org.uk\/blog\/?p=1947"},"modified":"2022-05-01T01:47:24","modified_gmt":"2022-05-01T01:47:24","slug":"redbridge-enforcement-actions-in-aldborough-ward-the-foi-results","status":"publish","type":"post","link":"https:\/\/ahda.org.uk\/blog\/2022\/05\/01\/redbridge-enforcement-actions-in-aldborough-ward-the-foi-results\/","title":{"rendered":"Redbridge Enforcement Actions in Aldborough Ward \u2013 The FOI results!"},"content":{"rendered":"\n<h2 class=\"has-medium-font-size wp-block-heading\"><strong>Redbridge say<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Enforcement Team tackle issues we know most matter to you like fly-tipping, untidy land and littering.&nbsp; We are charged with improving civic pride and clamping down on those who do not treat the Borough with respect.<\/p>\n\n\n\n<h2 class=\"has-medium-font-size wp-block-heading\"><strong>AHDA asked<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">How many enforcement actions have been taken by the Council for the following:-<br>a) Planning infringements where structures have been erected that have no prior planning permission. b) environmental infringements, including burning of waste. c) noise infringements all these a) to c) for Aldborough Ward for the last 5 years (from 2017) and how many of these have resulted in legal proceedings, fines and\/or penalties. <a href=\"https:\/\/www.whatdotheyknow.com\/request\/enforcement_actions_for_planning?nocache=incoming-2029956#incoming-2029956\">Our FOI Request.<\/a><\/p>\n\n\n\n<h4 class=\"has-medium-font-size wp-block-heading\"><strong>Our Chairs reaction to the results<\/strong><\/h4>\n\n\n\n<p class=\"has-vivid-red-color has-text-color wp-block-paragraph\"><em><strong>My overall view is that you can dump a car\/flytip\/race your car\/cut down as many trees as you want\/erect anything and have a loud party whilst doing it \u2013 oh, and you can have a bonfire too\u2026.<\/strong><\/em><\/p>\n\n\n\n<h4 class=\"has-medium-font-size wp-block-heading\"><strong>Brief Analysis of the results of the FOI<\/strong><\/h4>\n\n\n\n<ul class=\"has-black-color has-text-color wp-block-list\"><li><strong>Flytipping<\/strong>:  <strong>1,147<\/strong> reports, only <strong>3%<\/strong> resulted in Fixed Penalty Notice. NO Prosecutions.<br><\/li><li><strong>Noise Infringements:<\/strong>&nbsp;&nbsp;&nbsp;<strong>813<\/strong> complaints. NO prosecutions.<br><\/li><li><strong>Abandoned Vehicles:<\/strong>&nbsp; <strong>286<\/strong> cases in 3 years, only &nbsp;2 FPN\u2019s.<br><\/li><li><strong>Dog Fouling:<\/strong>&nbsp; <strong>206<\/strong> reports. NO Fixed penalties and NO prosecutions.<br>&nbsp;<\/li><li><strong>Littering:<\/strong>&#8211;&nbsp; <strong>202<\/strong> reports 5% FPN. NO prosecutions. 1 more FPN during the pandemic then the previous year! (whole borough 20,157 FPN\u2019s (LA Support)).<br><\/li><li><strong>Flyposting:<\/strong>&#8211; NO reports but 26 FPN\u2019s.<br><\/li><li><strong>Nuisance Vehicles:<\/strong>&nbsp; NO FPN, NO Prosecutions.<br><\/li><li><strong>Untidy land: 1 report<\/strong>, 98 FPN and 183 prosecutions.<\/li><\/ul>\n\n\n\n<h2 class=\"has-medium-font-size wp-block-heading\"><strong>Trees<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Redbridge says Tree Protection Orders (TPOs) protect tree(s) because they are <strong>significant<\/strong> or <strong>benefit the appearance of the area<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There was a total of <strong>122 complaints<\/strong> in Aldborough Ward,  2017 to 2021, the  average time to \u2018close\u2019 complaint 58 weeks!<\/p>\n\n\n\n<h2 class=\"has-medium-font-size wp-block-heading\"><strong>TPO trees removed or felled<\/strong>:<\/h2>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>33 reports<\/strong> or complaints of Trees with protection orders and or in a conservation area were removed or felled.<\/li><li><strong>8 <\/strong>closed as deemed \u2018not expedient\u2019 (<a href=\"https:\/\/www.gov.uk\/guidance\/tree-preservation-orders-and-trees-in-conservation-areas#expedient-means\">not in the interests of amenity<\/a> but were TPO).<\/li><li><strong>4 <\/strong>closed as \u2018immune\u2019<\/li><li><strong>2<\/strong> closed given retrospective planning<\/li><li><strong>4<\/strong> complaints not closed, 3 of which are 2yrs old or more<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The tree data contains other complaints ie illegal work on protected trees.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>2017<\/strong> &#8211; <strong>6 cases<\/strong> classed as \u2018not expedient\u2019. <strong>5 cases<\/strong> classed as benefit of consent \/ negotiation.<\/li><li><strong>2018<\/strong>&nbsp;&#8211;<strong>17 cases<\/strong> classed as not expedient \/ immune from action etc including <strong>3+<\/strong> cases involving Conservation Area.<\/li><li><strong>2019<\/strong> &#8211; <strong>12 cases<\/strong> classed as&nbsp;not expedient \/ immune<\/li><li><strong>2020<\/strong> &#8211; <strong>7 cases<\/strong> classed as not expedient \/ immune&nbsp;and&nbsp;<strong>10 cases still outstanding<\/strong>.<\/li><li><strong>2021 <\/strong>&#8211;<strong> 3 cases<\/strong> classed as not expedient \/immune and&nbsp;<strong>11 cases still outstanding<\/strong><\/li><\/ul>\n\n\n\n<h2 class=\"has-medium-font-size wp-block-heading\"><strong>Planning enforcement &#8211; Redbridge still working on the reply.<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">We will do more detailed analysis once the full reply is received<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Redbridge say Enforcement Team tackle issues we know most matter to you like fly-tipping, untidy land and littering.&nbsp; We are charged with improving civic pride and clamping down on those who do not treat the Borough with respect.
